1. DEFINITIONS
1.1 “Practice” means The Labyrinth Alcove Counselling & Psychotherapy, operated by Amanda Zoltek, MSW, RSW, including any present or future employees, independent contractors, associates, supervisees, agents, representatives, successors, or assigns.
1.2 “Website” includes all webpages, content, blogs, embedded media, forms, booking links, downloadable materials, subdomains, and associated digital properties operated by the Practice.
1.3 “Services” include psychotherapy, counselling, perinatal mental health services, parent and caregiver support, group therapy, workshops, clinical supervision (current or future), digital products, online courses, and related offerings.
1.4 “User” means any individual accessing or using the Website.
2. ACCEPTANCE OF TERMS
2.1 These Website Disclaimer and Terms of Use (“Terms”) form a legally binding agreement between the User and the Practice.
2.2 By accessing the Website, submitting a contact form, subscribing to communications, booking Services, or otherwise interacting with the Website, the User confirms acceptance of these Terms.
2.3 If the User does not agree, they must discontinue use immediately.
2.4 The Practice may update these Terms at any time. Continued use after updates constitutes acceptance.
3. PROFESSIONAL STATUS & REGULATION
3.1 Amanda Zoltek is a Registered Social Worker licensed in Ontario and regulated by the Ontario College of Social Workers and Social Service Workers (OCSWSSW).
3.2 The Practice operates in accordance with:
· The Social Work and Social Service Work Act, 1998
· The Personal Health Information Protection Act, 2004 (PHIPA)
· The Personal Information Protection and Electronic Documents Act (PIPEDA)
· The Health Care Consent Act (HCCA)
· OCSWSSW Standards of Practice and Code of Ethics
3.3 Amanda Zoltek is a Health Information Custodian (HIC) under PHIPA.
3.4 Nothing in these Terms limits statutory rights or professional obligations imposed by law or regulation.
4. AGE, CAPACITY & CONSENT
4.1 The Practice provides Services to individuals aged 16 and older.
4.2 In accordance with the Health Care Consent Act, capacity to consent to treatment is determined on an individual basis, not solely by age.
4.3 Where a client lacks capacity, consent will be obtained from a legally authorized substitute decision-maker.
4.4 Accessing this Website does not establish capacity for treatment nor constitute consent to care.
5. NO THERAPEUTIC RELATIONSHIP
5.1 Use of the Website does not create a therapeutic, clinical, fiduciary, supervisory, or professional relationship.
5.2 A therapeutic relationship is established only after:
(a) Completion of intake procedures;
(b) Mutual agreement to provide Services;
(c) Execution of informed consent documentation.
5.3 Website interaction, contact forms, blog engagement, newsletter subscription, or electronic messages do not create a therapeutic relationship.
6. EMERGENCY & SUICIDE RISK LIMITATION
6.1 The Website is not monitored for emergencies.
6.2 No crisis intervention is provided via email, text, or website forms.
6.3 Individuals experiencing crisis must contact:

6.4 Website content is not a substitute for suicide risk assessment or emergency intervention.
7. GEOGRAPHIC LIMITATION & INTERNATIONAL USERS
7.1 Professional Services are provided only to individuals physically located in Ontario at the time Services are rendered.
7.2 Accessing this Website from outside Ontario or Canada does not create a professional relationship, jurisdictional consent, or availability of Services.
7.3 The Website may be accessed internationally; however, regulated clinical services are restricted to Ontario.
8. INFORMATIONAL PURPOSES ONLY
8.1 Website content is educational and informational only and does not constitute psychotherapy, medical advice, diagnosis, or treatment. Reliance on Website content is at the User’s own risk.
9. ELECTRONIC COMMUNICATIONS
9.1 Administrative communication may occur via email or text at the User’s request.
9.2 Clinical advice, therapeutic intervention, and risk assessment will not be provided via unsecured email or text.
9.3 Electronic communications carry inherent cybersecurity risks.
9.4 The Practice is not responsible for unauthorized access arising from:
· Client device vulnerabilities
· Shared devices
· Compromised email accounts
· Carrier-level vulnerabilities
9.5 Response times are not guaranteed. Electronic communication is not suitable for urgent matters.
10. COOKIES & WEBSITE ANALYTICS
10.1 The Website is hosted on Squarespace and may use built-in analytics tools.
10.2 Analytics may collect non-identifying information such as:
· IP address
· Browser type
· Pages visited
· Time spent on pages
10.3 Cookies may be used to improve website functionality and performance.
10.4 Users may disable cookies through browser settings; however, some functionality may be affected.
10.5 Analytics data is used for internal business insights and not sold or commercialized.

11. THIRD-PARTY PLATFORMS
11.1The Practice uses Jane Software Inc. for booking, record storage, and virtual service delivery.
Third-party platforms operate under their own privacy policies. The Practice conducts reasonable due diligence but does not control external systems.
12. SUPERVISION & FUTURE GROWTH
12.1 The Practice may expand to include contractors or supervisees.
12.2 Independent contractors are responsible for their own regulatory compliance.
12.3 Participation in supervision does not create a therapist-client relationship between a client and a supervisor unless explicitly agreed.
13. INTELLECTUAL PROPERTY
13.1 All Website content is owned by the Practice unless otherwise stated. This excludes stock photographs, images, graphics, or other third-party materials, which remain the property of their respective owners and are used under licence.
13.2 Users are granted a limited, non-transferable, non-commercial licence for personal use only.
13.3 Unauthorized reproduction or distribution is prohibited.
14. ACCEPTABLE USE
Users shall not:
· Attempt unauthorized access
· Interfere with system integrity
· Introduce malicious code
· Use Website content unlawfully
Access may be restricted for violations.
15. DISCLAIMER OF WARRANTIES
The Website is provided “as is” and “as available.”
The Practice does not guarantee uninterrupted or error-free operation.
16. LIMITATION OF LIABILITY (WEBSITE USE ONLY)
16.1 This limitation applies solely to Website use and not to regulated clinical services governed by separate informed consent agreements.
16.2 To the maximum extent permitted by law, the Practice is not liable for indirect, incidental, or consequential damages arising from Website use.
16.3 Total cumulative liability relating to Website use shall not exceed the greater of:
· CAD $500; or
· Fees paid in the three (3) months preceding the claim.
16.4 Nothing excludes liability that cannot legally be excluded.
17. FORCE MAJEURE
The Practice is not liable for delays or failures due to causes beyond the Practice's reasonable control, including:
· Cyber incidents
· Internet outages
· Public health emergencies
· Regulatory changes
· Natural disasters
18. DISPUTE RESOLUTION
18.1 The parties agree to attempt good-faith resolution of disputes.
18.2 If unresolved, disputes shall first proceed to mediation in Ontario.
18.3 If mediation fails, disputes may proceed to binding arbitration in Ontario.
18.4 Arbitration shall be conducted individually and not as a class action.
18.5 If arbitration is found unenforceable, disputes shall be resolved in Ontario courts.
18.6 Nothing prevents the Practice from seeking injunctive relief where appropriate.
19. GOVERNING LAW
These Terms are governed by the laws of Ontario and applicable federal laws of Canada.
Users attorn to the jurisdiction of Ontario courts.
20. SEVERABILITY
If any provision is unenforceable, remaining provisions remain in full force.
21. SURVIVAL
Limitation of liability, dispute resolution, intellectual property, and indemnification provisions survive termination of Website use.
22. ENTIRE AGREEMENT
These Terms and the Privacy Policy constitute the entire agreement regarding Website use.
